Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://vandvlighting.com website (the “Service”) operated by V&V Lighting LLC (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of V&V Lighting LLC and its licensors.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by V&V Lighting LLC.
V&V Lighting LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that V&V Lighting LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Terms & Conditions
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
- The warranty for installation covers one year of labor and five years of material (bulb & fixture) from the date of installation.
- In the event of significant rainfall exceeding 40% during the scheduled installation date, the installation will be rescheduled for the next available date.
- Upon placing an order, if the customer chooses not to proceed with the installation, a return and restocking fee of $250 will be deducted from the advance payment.
- Should the customer request alterations to the design during or after installation, including changes to light placement, additions or removals of lights, replacement of light fixtures or bulbs, the customer assumes sole responsibility for any outcomes resulting from such alterations. V&V Lighting LLC shall not be held responsible for any consequences arising from such alterations.
- All uplights designated for peaks or sides of peaks will be installed on the soffit. V&V Lighting LLC reserves the right to determine whether gutter mounts are necessary for light installation on peaks.
- Downlights will only be installed under the soffit using circular Shaw with a hole ranging from 60mm to 70mm.
- If the customer requests modifications after installation is completed, a charge of $100 per light will apply.
- In the event of the uninstallation or removal of all lights or the installed lighting system at the customer’s request, a flat fee of $1250 or 30% of the total order, whichever is higher, will be charged. V&V Lighting LLC will not be liable for any damage incurred during the uninstallation process, and all materials will be retrieved from the customer’s site after removal. Any soffit light installtion can not be un done.
- The material and labor warranty applies only to light fixtures and bulbs purchased from V&V Lighting LLC if the customer has an existing landscape system from another vendor.
- V&V Lighting LLC reserves the right to cancel orders with prior notice and to modify the design before and during installation with prior notice.
- All LED bulbs have a rated lifespan of 40,000 hours or less.
- The timer component of the transformer is covered by a one-year material warranty.
- The WiFi module is covered by a one-year material warranty.
- Any repair or maintenance performed by a third-party vendor on light fixtures installed or serviced by V&V Lighting LLC voids the labor and material warranty immediately.
- A GFCI outlet must be used to power the lighting system installation. Damages caused by non-GFCI issues such as power surges or lightning strikes are not covered under warranty.
- Customers using a photo-electric timer may experience irregular timing of lights due to external light influences. WiFi modules provide more regular timing based on location sunset/sunrise times.
- For gutter mounts, V&V Lighting LLC will apply silicon for screws and mounts during installation. Customers are responsible for reapplying silicon every 3 to 4 years to prevent water leaks.
- The use of a WiFi module is not recommended for customers experiencing WiFi disconnect issues or with multiple devices connected to the router, especially those using a mesh WiFi system.
- WARNING: Directly staring at landscaping lights when powered on may cause temporary or permanent damage to vision.
- Customers must report any faults by filling out a form or calling our mobile phone. Repairs will be scheduled based on availability, with an average turnaround time of 5 to 8 business days. A service/repair visit fee of $100 to $150 will be charged.
- Late payments will incur a penalty of $100 if not paid by the due date. Failure to pay the penalty or outstanding amount within 30 days of the invoice date will result in reporting to a collection agency.
- If a customer stops the light installation due to dependency on other vendors/workers, the installation will be rescheduled for the next available date, with the customer responsible for any additional installation fees incurred.
- Customers must clearly mark the path of dog fencing systems, sprinkler systems, utility cables, and pipes before the installation date. Failure to do so will result in V&V Lighting LLC assuming no such systems are installed, and the company will not be responsible for any damage caused to these systems.
- Neither party shall be liable for delays caused by Acts of God, war, civil commotion, fire, flood, labor difficulties, shortages of labor, materials or equipment, government regulations, unusually severe weather, or other causes beyond reasonable control. Such delays shall not be eligible for repairs or warranty claims
Governing Law
These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
